General Policy

Stater Bros. Markets (“Stater Bros.,” “we,” “us,” or “our”) adopted the following Website/Digital Services Privacy Policy (“Privacy Policy”) to inform users of www.staterbros.com and any of its web properties, including but not limited to shop.staterbros.com, careers.staterbros.com, coupons.staterbros.com, catering.staterbros.com (“you,” “your,” or “User”), as to how our website(s), services, products, and software applications (collectively, the “Sites”) collect, store, and use personal information submitted via the Sites. This Privacy Policy is only applicable to webpages available on the Sites and not to any other websites that you may be able to access from the Sites, including, without limitation, the websites of Instacart, DoorDash, Uber Eats, Upromise, and SavingStar, which such other websites may have data collection and use practices and policies that materially differ from this Privacy Policy. Stater Bros. is not responsible for the privacy practices or the content of other websites that may be linked to the Sites. You should carefully review the privacy policies of those websites to determine how they treat your Personal Information.

Collection of Information

Information We Collect

We collect information you provide directly to us, information from third parties, and information that we collect through automated means, such as when you access the Sites or open an email we send you. Such information may include “Personal Information”, which means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information may include the following categories of information about you or your use of the Sites: (1) identifiers (such as name, telephone number, postal address, email address, unique personal identifier, or account name); (2) commercial information (such as transaction data); (3) financial data (such as credit card or debit card information); (4) Internet or other network or device activity (such as browsing history, search history, the pages or products you view, the websites or search terms that brought you to the Sites, or interactions with our Sites and advertisements); (5) device identifiers (such as IP address and the type of web browser or device you use); (6) geolocation information (such as general location inferred from your IP address or, if you enable location-based services, more precise geolocation); (7) order information (name, billing and shipping addresses, payment information, email address, and phone number); (8) inference data about you (such as profiles or preferences we may derive from your activity on our Sites); (9) legally-protected classifications (such as if you reveal your gender, age, or similar demographic information); (10) physical characteristics or descriptions (such as if you provide us with a photograph or if you are recorded by in-store video surveillance systems while visiting our retail locations); (11) sensory information (such as if you call us and leave a voicemail or are captured on security camera footage maintained for security, loss-prevention, or legal compliance purposes); (12) Sensitive Personal Information, as defined under California law, but only to the extent you provide it to the Sites (such as if you provide government identifiers or enable precise geolocation); and (13) other information that identifies or can be reasonably associated with you. We may also collect non-personally identifiable information, such as the date and time of your visit, time zone, documents or coupons downloaded, the cookies installed on your device, and other “traffic data” (“Traffic Data”). We may link Traffic Data to the Personal Information you submit while on the Sites, when you are logged into the Sites, or in connection with a service you have requested. For example, if you sign up for Digital Deals, we will store your Digital ID together with your email address so that you can manage your account.

Sharing your information is optional; you may decline to provide us with your Personal Information. However, failure to provide certain Personal Information may prevent you from accessing certain services offered on the Sites. As described below, you may review, change, or remove certain types of your Personal Information through your account settings.

Exclusion of Text Messaging Originator Opt-In Data

All the above categories exclude text messaging originator opt-in data and consent. Information provided for the purpose of receiving SMS text messages will be used only to deliver such messages and will not be sold, shared, or otherwise disclosed to any third parties except as necessary to provide the text messaging service. How We Collect Information

We collect Personal Information from the following categories of sources: directly from consumers, automatically through their interaction with our Sites, from service providers and contractors (such as analytics, advertising, and delivery partners), from social networks, and from other lawful third-party data sources.

    1. Information You Provide Directly.

We collect information you provide to us when you access or use our Sites, request information from us, register with us (including when you link your profile on a third-party site or platform with your registration account), participate in public forums or other activities on our Sites, respond to User surveys, or otherwise interact with us online or offline.

We also collect Personal Information when you complete a purchase through our Sites or at our retail stores. This may include order information, such as items purchased, payment details, billing and shipping addresses, and other information necessary to process your transaction.

If you communicate with us by email or otherwise complete online forms, surveys, or sweepstakes or other promotional entries, we may retain those communications and collect all information contained therein, including, without limitation, your email address as Personal Information.

We may also collect Personal Information that you have provided us offline, such as at events or through the mail. When we collect personal information offline, including through in-store loyalty or checkout systems, we provide appropriate notice at or before the time of collection, directing consumers to our Privacy Policy and their opt-out and limitation rights.

    2. Cookies.

From time to time, we may also use the “cookies” feature of major browser applications. This feature allows us to store a small piece of data on your computer about your visit to our Sites. Cookies are small files of information that save and retrieve information about your visit to the Sites. We may use cookies to make your visit to the Sites easier. For example, cookies allow us to recognize you when you re-enter the Sites and allow us to count the number of unique and returning visitors who use the Sites. Promotions or offers displayed on our Sites may also contain cookies. We do not have access to or control over information collected by outside promoters on our Sites.

Most browsers are initially set up to accept cookies. If you do not wish information to be gathered on a cookie, it may be possible to disable the acceptance of cookies by changing the settings on your web browser. However, disabling cookies may impair your access to and ability to utilize certain features on the Sites. Your experience at the Sites may be diminished, and some features may not work as they were intended if you disable cookies. If you are not sure whether your browser has the capability to opt out of receiving cookies, you should check with the software manufacturer or your internet service provider.

The Sites also use web beacons (also known as clear gifs or pixel tags), which are tiny graphics with a unique identifier that are placed in the code of a webpage. We may also collect information through log files, which track actions on the Sites and capture data such as IP address, browser type, Internet service provider, referring and exit pages, and timestamps.

    3. Web Beacons and Pixels

Our Sites and emails may use third-party pixels (also known as web beacons, clear gifs, or pixel tags) and similar technologies, including Hotjar tracking tags. These are tiny graphics with a unique identifier that are placed in the code of a webpage or email. Third-party pixels may collect data such as your IP address, browser type, operating system, device information, website pages visited, interactions with content, referring and exit pages, timestamps, and other browsing behavior across our Sites and other websites over time. This information may be used for a variety of purposes, including tracking user engagement, measuring the effectiveness of advertising campaigns, analyzing website traffic, understanding and optimizing user experiences, personalizing content and advertisements, and providing relevant offers and promotions. Information collected through these technologies may be transmitted to third parties (such as advertising networks, analytics providers, or retail media partners) and may constitute a “sale” or “sharing” of Personal Information under California law. We do not have direct control over the activities of third-party pixels or the data they collect. By continuing to use our Sites, you consent to the use of these technologies as described in this Privacy Policy. You may manage your cookie settings at any time through the cookie preferences available on our Sites, which allow you to review and adjust the categories of cookies and similar technologies that are active, including opting out of those that are not essential. You may also choose to opt out of certain tracking activities by adjusting your browser settings, utilizing browser-based preference signals such as the Global Privacy Control (GPC), or using opt-out mechanisms provided by third-party advertisers and analytics providers.

    4. Analytics Tools

We may collect information using third-party analytics tools, including Google Analytics and Google Tag Manager, to help us gather and analyze information about the areas visited on the Sites (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the User experience and the functionality of the Sites.     5. Information From Other Sources.

We acquire information from other trusted sources to update or supplement the information you provided, or we collected automatically, such as when we validate postal address information using third-party services. Applicable law may require that you authorize the third party to share your information with us before we can acquire it.

    6. Information From Social Networks.

If you access our Sites through a third-party connection or log-in (like a social network), we may collect certain information from your social network profile. For a description of how social networking sites handle your information, please refer to their privacy policies and terms of use, which may permit you to modify your privacy settings. If you do not want to share information from your social network profile, do not access our Sites through that third-party service.

    7. Location-Based Services.

Use of the Sites may include location-based services, in which case we may receive information about your location and use that information to send you geographically relevant promotions or advertisements.

    8. In-Store Systems and Security Monitoring.

We collect certain Personal Information automatically in our physical retail locations through in-store technologies such as video cameras, security systems, and other monitoring equipment. These systems may capture images, video, or other visual information about individuals who enter or move through our stores. Such information is used solely for safety, loss-prevention, compliance, and operational purposes, including but not limited to monitoring check stand stability, evaluating queuing and traffic patterns, assessing shelf conditions, and reviewing the effectiveness of store layouts and product displays. This information is not used for advertising, marketing, or customer profiling.

Internal Use of Information

We may use Traffic Data or Personal Information for business purposes, including to process, fulfill, or follow up with transactions, to send you information about Stater Bros., our services, or promotional material (some of which are in connection with our partners), or to otherwise contact you. We may also use your Traffic Data or Personal Information to customize and tailor your experience on the Sites, for example, to display content that we think may be of interest to you. We may also use your Personal Information to inform you of any changes to the Sites, to verify your identity, to add you to our mailing lists, to manage your account, or otherwise contact you with promotions or offers. We may also use your Personal Information to operate, understand, optimize, develop, or improve our Sites, including bug detection and error reporting, and to ensure security, fraud, and legal compliance, including detecting, investigating, and preventing activities that may violate our policies or be illegal. Information collected through in-store video or security systems is used solely for these legitimate business purposes, including safety, loss prevention, and compliance with legal obligations, and is not used for marketing or advertising.

We reserve the right to send you communications that alert you to important information regarding the Sites, including, but not limited to, notices regarding policy updates, service changes, or legal matters that may affect your use of the Sites.

How We Share or Sell Your Information with Third Parties

Stater Bros. may share, sell, or otherwise disclose certain categories of your Personal Information or Traffic Data as described below. All categories of Personal Information listed in the section titled “Information We Collect” may be shared, sold, or otherwise disclosed, and may have been shared, sold, or otherwise disclosed in the preceding 12 months, for the purposes described in this Privacy Policy. Some of these disclosures may be considered as a “sale” or “sharing” of Personal Information under California law. However, Stater Bros. does not sell, share, or otherwise disclose Sensitive Personal Information. Stater Bros. uses such Sensitive Personal Information only for purposes permitted under the CCPA/CPRA, such as completing transactions, ensuring security, preventing fraud, and complying with legal obligations.

We may share or sell each remaining category of Personal Information or Traffic Data to the following categories of third parties and for the following purposes:

    1. Service Providers, Affiliates, and Contractors.

We may share Personal Information or Traffic Data with third-party service providers, affiliates, and contractors that we use to perform services for the Sites. These services include, without limitation, website hosting, Site maintenance, providing key Site functions, information processing, completing audits, responding to inquiries, sending email, fulfilling requests, and customizing or delivering coupons, marketing materials, or advertisements. These service providers, affiliates, and contractorsare prohibited from using your Personal Information for any purpose other than those requested by us or required by law, and they are required to safeguard your information.

    2. Business Partners and Advertising/Analytics Providers.

We share or sell Personal Information or Traffic Data with data analytics providers, advertising networks, and retail media network participants to help deliver personalized advertisements, measure campaign effectiveness, and improve services.

    3. When You Choose to Disclose Information.

We disclose Personal Information at your direction, such as when you request that we share your information with selected companies so they can send you offers and promotions, or when you direct us to share your information with third-party platforms (for example, social networks). In these cases, the information is controlled by the other company and subject to its privacy practices.

    4. Corporate Transactions.

In the event that all or a portion of our business is acquired by or merged with a third-party, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you, including, without limitation, Traffic Data and Personal Information, to the third-party as part of such merger, acquisition, sale, or other change of control.

    5. Legal, Safety, and Enforcement Purposes.

We may disclose Personal Information to enforce our Terms of Use, protect the safety and security of our customers and others, or protect our rights and property. In addition, we may disclose Personal Information in order to defend against or respond to third-party claims or allegations; investigate or prevent misuse or unauthorized use of the Sites; investigate or address abusive, harassing, or fraudulent activity (including use of false email addresses); and respond to emergencies where we believe someone’s physical safety may be at risk or to protect the safety of the public or users of the Sites. We may disclose Personal Information if we determine, after reasonable review and consultation with our legal team, that disclosure is necessary to comply with applicable law, regulation, legal process, or governmental request (including national security or law enforcement requirements).

Security and Retention of Personal Information

The security, integrity, and confidentiality of your Personal Information are extremely important to us. We have implemented technical, administrative, and physical security measures that are designed to protect User information from unauthorized access, disclosure, use, and alteration. We regularly review our security procedures to incorporate new technologies and methods, as needed. However, please be aware that despite our best efforts, no security measures are perfect or impenetrable. We make no assurances about our ability to prevent any such loss or misuse to you or to any third party arising out of any such loss, misuse, or alteration.

We will retain each category of Personal Information or Sensitive Personal Information for the period reasonably necessary to achieve the purpose for which it was collected outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Where we cannot specify a fixed retention period, we will determine retention based on criteria such as the nature of the information, the purpose of collection, and legal or business obligations. After the retention period ends, we will securely delete, anonymize, or otherwise render the information irreversibly de-identified. Note that Personal Information may persist in copies made for backup or archival copies for additional limited time for business continuity and disaster recovery purposes.

California Consumer Privacy Act of 2018

The following section on the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq.) (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”), applies to California residents who have certain rights regarding Personal Information collected by Stater Bros. This Section explains those rights and how to exercise them.

California Residents Have the Following Rights Under CCPA

  • Right to Know/Access. Subject to certain exceptions, you have the right to know what specific pieces of Personal Information Stater Bros. has collected about you in the 12 months preceding your request, along with the categories of Personal Information we have collected, the categories of sources of that Personal Information, our business or commercial purpose for collecting and/or selling your Personal Information, and the categories of third parties with whom we share, sell, or otherwise your Personal Information. You may make this request no more than twice per 12-month period.
  • Right to Delete. Subject to certain exceptions, you have the right to request deletion of the Personal Information Stater Bros. has collected from you. Pursuant to the CCPA, the exceptions include:
    • Completing the transaction for which the Personal Information was collected;
    • Detecting security incidents or protecting against and prosecuting malicious, deceptive, fraudulent, or illegal activity;
    • Complying with our legal or compliance obligations; and
    • Other reasons that are in connection with our lawful internal uses that are consistent with your relationship with us and the context in which the Personal Information was collected.
  • Right to Correct. You have the right to request the correction of inaccurate Personal Information that we maintain about you. If we are not the source of the information you seek to correct, we will either identify the source or notify that source of the correction, as required by law.
  • Right to Opt-Out of Sale or Sharing of Personal Information. You have the right to direct us not to sell your Personal Information to third parties, or to share it for cross-context behavioral advertising purposes. You may exercise this right at any time. To submit a request to opt out of the sale or sharing of your Personal Information, you may use the “Do Not Sell or Share My Personal Information” link on our homepage or submit a request via Phone, Email or the Privacy Portal. We also honor browser-based opt-out preference signals (such as the Global Privacy Control, or GPC) as a valid request to opt out of the sale or sharing of your Personal Information. Once we receive and process your opt-out request, we will not sell or share your Personal Information unless you later provide authorization for us to do so.
  • Right to Limit Use of Sensitive Personal Information. At this time, we do not use or disclose Sensitive Personal Information for any purpose that would trigger the right to limit under the CCPA/CPRA. We only use or disclose Sensitive Personal Information for purposes that are necessary to perform the services or provide the goods you have requested, or as otherwise permitted by law. For example, if we collect your credit card number for a transaction, we use it only to process that transaction and not for profiling or marketing. You have a right to limit the use and disclosure of Sensitive Personal Information beyond what is reasonably necessary and proportionate to provide the requested goods and services.
  • Right to Non-Discrimination. Stater Bros. will not discriminate against you if you exercise your rights under CCPA. However, if your request requires us to delete, restrict, or not share information, please be advised that this will inhibit some functionality of the Site. For example, certain features (such as personalized offers or loyalty rewards) may not function if you delete your data or opt out of sharing. Any subsequent interaction with the Site after deletion will require new requests for action on your data.
  • Right to Access Metrics. You can access Stater Bros.’s metrics for the last calendar year about the number of requests to know, requests to delete, requests to correct, and requests to opt-out that we received, complied with (in whole or in part), and denied, and the median number of days in which we responded to those requests, by going to www.staterbros.com/contact/.
  • Right to Confirm. Where applicable, you may request confirmation that certain Sensitive Personal Information we maintain about you matches the information you have provided, subject to verification and appropriate security measures.

Exercising Your Rights under CCPA and Verification

You can exercise any of your rights under the CCPA, or obtain more information for your questions or concerns about this Privacy Policy, by going to the Privacy Portal, by emailing us at CustomerSupport@staterbros.com or by calling 1-855-782-8377.

You are permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide written permission for the authorized agent to make such requests or a power of attorney. We may also follow up with you to verify your identity according to the following methods before processing the authorized agent’s request. If you designate an authorized agent, we will not require you to resubmit your request directly once your agent’s authority has been verified.

We will take reasonable steps in light of the nature of the Personal Information requested to verify your identity before responding to a request.

For example, to complete the verification process, we may ask you to both: (1) provide at least two pieces of evidence that match the Personal Information that we have on file for you, such your name, email address, or billing information such as the last 4 digits of the credit card used or the billing address for a transaction; and (2) provide a statement that you “declare under penalty of perjury” that you are the person about whom the request has been made. For requests for specific pieces of Personal Information for which a higher degree of certainty is required, we may request additional pieces of evidence that match the Personal Information that we have on file for you.

In the unlikely event that we are not able to verify your identity from the Personal Information that you provided in your request or that we already have on file for you, we may request additional information from you. Such additional information would only be used for purposes of verifying your identity, for security or fraud-prevention purposes, or as otherwise required by law. We will delete the additional information as soon as practicable after processing your request.

If we are not able to successfully verify your identity using the above methods, then we will not be able to comply with your request. However, as provided under the CCPA, if we cannot verify your identity in connection with a Request to Delete, we will treat the request as a request to opt out of the future sale or share of your Personal Information.

When you submit a privacy request through our online Privacy Portal, the request is securely transmitted to and processed through Truyo, our designated privacy request platform. Truyo acts solely as our service provider under California law and is contractually prohibited from using personal information for any purpose other than verifying, managing, and fulfilling privacy requests on our behalf. Information collected through the Privacy Portal is used only to authenticate your identity (where required) and to process your request. It is not sold, shared, or used for any advertising, analytics, or unrelated business purposes.

After you submit an opt-out, limitation, or other privacy request, we will provide confirmation that your request has been received and, where applicable, that we are verifying your identity. Once your request has been verified and processed, we will provide a confirmation that it has been completed.

Exemptions under the CCPA

Certain types of information and activities are exempt from the requirements of the CCPA and CPRA. For example, these laws do not apply to information subject to federal privacy laws such as HIPAA, GLBA, or the Driver’s Privacy Protection Act, or to Personal Information collected or used in an employment, contractor, or business-to-business context, as permitted by law. They also do not apply to deidentified or aggregate consumer information, as defined in California Civil Code Section 1798.145. Stater Bros. maintains appropriate technical and organizational safeguards to ensure that any deidentified or aggregate data cannot reasonably be used to infer information about, or reidentify, an individual consumer. The CCPA and CPRA likewise do not require Stater Bros. or its service providers to reidentify, retain, or link information that is not maintained in a personally identifiable form, or to collect additional data solely to associate a request with a specific consumer.

Other Rights of California Residents

If you are a California resident, California Civil Code section 1798.83 permits you to request information regarding the disclosure of your Personal Information to third parties for the third parties’ direct marketing purposes. To make such a request, please send an email to privacy@staterbros.com. Pursuant to California Civil Code section 1798.83(c)(2), we do not share your Personal Information with third parties for direct marketing use if you have opted out of such sharing. Otherwise, we may share your Personal Information with third parties for their direct marketing purposes as described in this Privacy Policy.

If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California Business and Professions Code section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please contact us with a detailed description of the specific content or information. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

California Invasion of Privacy Act (CIPA)

The California Invasion of Privacy Act (Cal. Penal Code §§ 630–638.55) prohibits the interception or recording of certain communications without the consent of all parties. Stater Bros. does not use its Sites to secretly intercept or record communications with Users.

Certain technologies used on our Sites (such as cookies, pixels, analytics tools, and similar interaction-monitoring technologies) may capture limited information about how you interact with our webpages for legitimate business purposes such as ensuring functionality, maintaining security, detecting fraud, and improving Site performance. Some of these technologies are operated by third-party advertising, analytics, or measurement providers, which may collect information directly from your browser or device and may use it for their own purposes in accordance with their privacy policies. Where required by law, Stater Bros. treats such activity as a “sale” or “sharing” of Personal Information and provides Users with the right to opt out.

Stater Bros. provides notice of these technologies and obtains consent through our cookie banner and this Privacy Policy. By accepting cookies or continuing to use our Sites after receiving our privacy notice, you consent to the use of these technologies as described. Stater Bros. does not knowingly permit any third party to intercept or record communications through our Sites without such notice and consent.

Minors

We understand and are committed to respecting the sensitive nature of children’s privacy online. We are a general audience site, and do not direct any of our content specifically at children under sixteen (16) years of age. We treat all personal information of consumers under sixteen (16) years of age as Sensitive Personal Information, as defined under California law, and limit its use and disclosure to the purposes permitted by law. We also do not knowingly sell or share the Personal Information of consumers under sixteen (16) years of age unless we have received the appropriate authorization to do so, as required by applicable law. We do not knowingly collect any Personal Information from children under the age of thirteen (13), and children under thirteen (13) are not permitted to register for an account or use our Sites. If we learn or have reason to suspect that a Site User is under the age of thirteen (13), we will promptly delete any Personal Information obtained from that User.

Third-Party Websites

At times, you may be prompted to leave the Sites under the control of Stater Bros. and enter an outside website, including, without limitation, the websites of Instacart, DoorDash, Uber Eats, Upromise and SavingStar. Stater Bros. does not make any representations or warranties about any affiliated or non-affiliated advertisers that may advertise on our Sites or any website you may access through our Sites. Any such advertiser or website is independent from Stater Bros., and Stater Bros. has limited or no control over or responsibility with respect to the information provided or activities undertaken by any such advertiser or website. Further, a link between our Sites and another website does not mean that Stater Bros. endorses that website. Stater Bros. is not responsible for the privacy practices or the content of other websites that may be linked to the Sites. You should carefully review the privacy policies of those websites to determine how they treat your Personal Information. You need to make your own independent decisions regarding your interactions or communications with any other website. Please refer to the web address in your browser’s address bar to determine if you have left our Sites (e.g., coupons.staterbros.com or staterbros.com). Except as otherwise provided under applicable law, neither Stater Bros. nor its corporate affiliates, nor the directors, officers, employees, agents, contractors, successors or assigns of each, shall be liable for any damages whatsoever arising out of or related to the use of the Sites or any other website linked to or from the Sites. This limitation of liability applies to direct, indirect, consequential, special, punitive or other damages you or others may suffer, as well as damages for lost profits, business interruption or the loss of data or information, even if Stater Bros. is notified in advance of the potential for any such damages.

Other State Rights

Our operations are located in California. Other states (including Colorado, Connecticut, Utah, and Virginia) have enacted consumer privacy laws that provide residents with rights similar to those described in this Privacy Policy. If you reside in one of those states, we will honor such rights to the extent applicable.

Access From Outside the United States

If you are visiting or accessing our Site from outside of the United States, please be advised that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other related laws in the United States, and other countries, might not be as comprehensive as those in your country. By allowing us to collect information about you by using our services, you consent to the transfer of your information to our facilities and those third parties with whom we share it as described in this Privacy Policy. If you are in the European Economic Area (EEA), United Kingdom, or other regions with data protection laws, you may have additional rights under those laws (for example, rights provided by the EU General Data Protection Regulation (GDPR)). This may include rights to access, correct, delete, or restrict the use of your personal information, as well as the right to object to certain processing or request data portability.
